WARRANTY CERTIFICATE (Standard Form)

Thank you for purchasing a CANYCOM USA PRODUCT. Our warranty policies are explained below:
  1. Warranty Period for Equipment: All warranties expire on the first anniversary of the date of delivery to the Customer; provided, however, that warranties for metered products expire on the first anniversary or at 1000 metered use hours, whichever comes first.

  2. Periods for Attachments, Implements and Parts: Warranties may be different for these items. Ask your dealer for details.

  3. Explanation of Limited Warranty: CANYCOM USA warranties are limited warranties providing a guarantee by CANYCOM USA of the products it distributes, promising to repair or replace parts which have a defect in materials or workmanship. The warranty is "limited" because it is provided for a limited period of time and has certain other restrictions.

  4. Our Warranty: CANYCOM USA will, through our authorized dealers, repair or replace any genuine CANYCOM USA parts which are found by us to be defective in design, material or workmanship. The defect must occur during normal use of the product and within the warranty period. Repairs and replacements covered by the warranty will be at no charge for the part or the labor to replace it subject to certain limitations. Repairs shall be effected only with genuine CANYCOM USA parts or parts approved by us.

  5. Exclusions:
    1. General Exclusions. Our warranty will NOT cover the following failures: (i) failures resulting from carelessness in use and handling, negligence, or from the failure to properly maintain; (ii) failures that result from uses exceeding or otherwise outside the limitations stated in the product specifications; (iii) failures caused by a modification or alteration that is not approved by us; (iv) failures resulting from the use of parts other than our company's genuine or designated and approved parts; (v) failures resulting from a repair which is done other than by an authorized CANYCOM USA dealer or its designated service provider; or (vi) failures for which the customer fails to provide the information, materials and damaged parts, required by us to determine the cause of the failure.
    2. Other. This warranty does NOT cover: (i) pickup or delivery of the equipment; (ii) rental of replacement equipment during the repair period; (iii) products declared a total loss and subsequently salvaged; (iv) overtime labor charges; (v) freight charges for replacement parts; (vi) travel time or mileage; (vii) service calls; or (viii) transportation of equipment to dealer or the designated service provider from customer's home or other location.
    3. Customer Responsibilities. This warranty does NOT cover customer responsibilities such as: (i) consumable parts (including without limitation, clutch and brake linings, filters, light bulbs, glass, lubricants and coolants, belts, cutting blades, bucket teeth, spark plugs, tires and tracks, etc.); and (ii) normal wear and tear. It is the customer's responsibility to maintain the equipment in accordance with the instructions provided in the Operator's Manual. We recommend that you keep records and receipts; you may be asked to provide that the maintenance instructions have been followed. It is also your responsibility to operate the equipment safely, and for the use for which it was designed. If a defect in materials or workmanship occurs, it is your responsibility to cease operating the equipment until repairs are made. In such case, you should contact your dealer immediately so that repairs can be made in a timely manner.

  6. Presentation of Certificate: You must present the original warranty certificate issued for the specific equipment and provided upon purchase of the CANYCOM USA product in order to request warranty protection. Lost certificates will not be replaced. Without proper presentation of the certificate, services will be provided only at customer's cost.

  7. Transfer: If you sell your equipment, any remaining warranty coverage may be transferred to the new owner. Contact your dealer for details.

  8. Limitations: YOUR CANYCOM USA LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS WHICH VARY FROM STATE TO STATE. WE DO NOT AUTHORIZE ANY PERSON TO CREATE OF US ANY OBLIGATION OR LIABILITY OTHER THAN THAT STATED IN THIS LIMITED WARRANTY. THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY LIMITED TO THE TERM OF THE EXPRESS WRITTEN WARRANTY. UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE TO THE CUSTOMER OR ANY OTHER PERSON FOR ANY CONSEQUENTIAL, INCIDENTAL, ECONOMIC, DIRECT, INDIRECT, GENERAL, OR SPECIAL DAMAGES ARISING OUT OF ANY BREACH OF WARRANTY, EXPRESS OR IMPLIED. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO USE.
Warranty concerns may generally be resolved by your dealer. If the problem is not resolved to your satisfaction, then you may want to address the matter with the owner or management of the dealership.
